Fined $25.00 and Costs For Blocking Crossing
Twenty-five dollars and costs was the verdict of Justice of the Peace J. L. Ackerman, given last evening, at the hearing of the train crew which blocked the Fairmont street grade crossing for twenty-five minutes, on Monday morning, February 14th, the coldest day of the year.
Engineer C. F. Demmitt and Conductor Harry Knox were the trainmen arraigned and they claimed that the cold weather was responsible for their blocking of the crossing for such a length of time.
Mrs. A. J. McColly, Mrs. F. I. Bossart, Miss Belle McClelland, John Everett, Robert Seaton and Constable Rickard Painter were witnesses for the borough and they testified that he train had blocked the crossing for twenty-five minutes.
James B. Weaver represented the borough and questioned the trainmen. Mr. H. V. Hyland, superintendent of the L. V. R. R., was also present and asked some questions.
In the opinion of the Justice the trainmen had no good reason for blocking the crossing so long, so Conductor Knox was fined $25 and costs, and Engineer Demmitt was discharged. The trainmen have 20 days within to appeal the case if they are not satisfied. The charge was brought under the act of assembly, 1911, having reference to the blocking of grade crossings. One half of the fine goes to the State.
