Damage Suit Against L.V.R.R. Now Going On, In Greensburg
The case was called yesterday.
Arguments upon law points took up much of the morning in Judge McConnell's court, where the damage suit of Dr. J. B. Johnson, of Ligonier, against the Ligonier Valley Railroad, seeking $30,000 damages fur injuries received in the Wilpen branch wreck is going on.
Dr. Johnson was a passenger on the ill-fated train the afternoon of July 5th, 1912, when a freight train ploughed its was through it. He was injured badly.
He claims his injuries to have been of a permanent character, and his testimony, given yesterday afternoon was to the effect that since the accident his hearing had been impaired, and that he still suffered from internal injuries.
Other physicians were called in his behalf. They told of the extent of his injuries, especially as to their permanency. Dr. Johnson declared that by reason of his injuries he had been unable to look after his practice.
Charles Kuhn, conductor of the passenger train at the time of the wreck, was a witness for the plaintiff. His story was that he had received no orders to wait until after the freight had arrived. Testimony was introduced, evidently with the design of showing the company to have been criminally negligent, and thus making possible a claim for punitive damages.
This morning, the defense was begun.
A statement by the former general manager of the company was read, in which he set forth the manner in which the railroad was operated under his management, the testimony
being on the same line as that which he gave at the coroner's inquest.
Two Pittsburgh physicians were called in behalf of the defense. They stated that they had examined Dr. Johnson and had found him in fairly sound health. One stated, however, that the physician's heart was irregular.
