Town To Prosecute Railroad Conductor For Blocking Crossings
For fifteen minutes or more, yesterday, a long string of coal cars blocked all the crossings, on the L.V.R.R., the engine having been unable to get up the grade with the train.
It was just at the noon hour, that the blockade occurred, and the school children, escorted by their teachers, were among those who were held back.
Burgess Hughes happened to be on the scene, and he directed the conductor to break the train. The train was so long that one could not give signals from one end to the other, but finally the train was broken at the Main street crossing, and everybody went around that was, thus getting home in time for dinner.
Burgess Hughes, deeming the case a good one in which to take action, secured the name of the conductor, and sought the aid of Justice White in instituting proceedings under the Act of 1911, which provides that in case a crossing is blocked, the conductor or any other member of the crew may be charged with a penalty of $25, the company to be responsible for the payment, in case the railroad man should note possessed of the money.
The Act appears to be quite indefinite, however, as to the nature of the proceedings necessary to be undertaken, prior to the imposition of the penalty, and the case is hanging fire, pending a further inquiry into the meaning and intent of the law. The question appears to be whether the action should be for misdemeanor, or only a civil action.
Justice White decided, this afternoon, to make the action one in assumpsit and he set the hearing for next Monday evening, between the hours of six and seven.
