L.V. R.R. Will No Longer Contest Crossing Case
The Borough of Latrobe may start at once, if it so desires, upon the construction of the crossing over the L. V. R. R. at Weldon and Spring streets, now that the Supreme Court has affirmed the decision of the Court of Common Pleas, refusing to give the company a permanent injunction against the construction of the said crossings. The notice served by the borough council upon the railroad company more than seven years ago, to construct the said crossings, still holds good, and no further notice is necessary. The borough may begin the work at once.
Nothing can further delay the construction of the crossings, except an appeal to the United States Supreme Court, and there is no likelihood of such an appeal being taken. In fact it is said that the company has become reconciled to the fact that it cannot prevent the putting in of crossings, and it said, on good authority, that the company is now through with the case. Furthermore it is highly problematical whether the case is an appealable one, the company being chartered by this state, and no constitutional question being involved.
It is likely that the borough council will take up the matter of constructing the crossings, at the meeting to be held next Monday evening. The citizens living above the L. V. R. R.
want them, just as quickly as they can be put in, and there will likely be as little delay as possible in doing the work.
The two crossings will be dangerous crossings and care will have to be exercised in going over them, owing to the fact that the railroad companys weigh scale is located in the neighborhood. Now that the companys tonnage has increased the scale is in use most of the day, and cars and engines are constantly being shifted back and forth over the two streets.
