Decision Was Reserved
Case Between L.V.R.R. Co. And W.C.R.R. Co. Before Court Two Days
The injunction case of the L.V.R.R. vs. the Westmoreland Central R.R. was concluded last Friday night. Judge McConnell reserved his decision and it may be a week or two before it is handed down.
The case between the rival railroads was to determine whether a preliminary injunction granted some days ago restraining the Westmoreland Central company should continue. The bill of the Ligonier Valley company set forth that on March 1, 1902, a survey was
made for a branch of its line to run from Ligonier up the valley to Mill Creek and Hanna's Run a distance of four miles, for the purpose of tapping coal property owned by the company in that neighborhood. The Westmoreland Central company on May 6, according to the statement of the plaintiff company's bill, began grading and excavating for a line along the exact route laid out by the Ligonier Valley company. It was asked that the preliminary injunction granted recently be made permanent.
The Ligonier Valley company claimed that the route selected for its line is the only available one for that company, while the Westmoreland Central company can reach the same territory over a different route. It was also alleged that the records of the Recorder's office do not show that the Westmoreland Central company has even been duly incorporated.
The Seger Limber Company is the principal owner of the Westmoreland Central railroad.
