Preliminary Injunction Granted From Court
Work Stopped On The Westmoreland Central R.R. For A Time
Hearing Set For June 8th
On Petition Of The Ligonier Valley R. R. Company Preliminary Injunction Granted by Judge A. D. McConnell Last Saturday Restraining The Westmoreland Central R. R. Company From Further Operations On Right Aways Claimed By The L.V.R.R. Co. The Matter Will Be Fully Tested At The Hearing
Upon petition of the Ligonier Valley Railroad company, a preliminary injunction was Friday morning granted by Judge McConnell restraining the Westmoreland Central Railroad Company from further operations in the building of its line along the right of
way of the Ligonier Valley company. The affidavit of J. R. Mellon, president of the Ligonier Valley company sets forth that the line projected by his company was a branch of the line running from Latrobe to Ligonier reaching some coal property recently purchased. The statement further sets forth that the Westmoreland Central company has selected the same course for its line. The validity of the organization of the Westmoreland company is questioned, it being claimed that its operations are merely to interfere with those of the Ligonier Valley company, petitioner. The hearing of the case had been set for Monday morning at 9 o'clock.
The injunction was served on the officers of the defendant company on last Friday afternoon and on Saturday arrangements were made to continue the hearing to June 8th in order that the necessary witnesses may be subpoenaed and the matter fully presented to the court. This injunction does not restrain the defendant company from work on its road
leading from the line of the W.C.R.R. to the mines and this part of the work will continue.
The history of the building of this road and the development of the coal and timber interests of the valley by the Seger Coal & Coke Company is familiar to the readers of the Echo. The object of the building of the road it is claimed by the Seger Coal & Coke Company is the bringing to market of the coal and other materials to be found in abundance along the proposed line of the Westmoreland Central R.R. The final decision
of the matter is now with the court.
