Chas. Kuhn Gets Verdict For $10,000
When the sealed verdict, which the jury in the case of Charles Kuhn vs. the Ligonier Valley Railroad had handed in last evening, was opened in court, this morning, it was found that Mr. Kuhn had been awarded damages to the amount of $10,000.
The case went to the jury, last evening, after five o'clock, following arguments by counsel and the charge of the court. The jury was not out long, having returned with a sealed verdict at seven o'clock. The verdict was presented to the court at nine o'clock this morning.
The verdict is considered as being a complete vindication of Mr. Kuhn from responsibility for the disastrous wreck of July 5, 1912. This was the last suit developing from the wreck and was the only one in which an employee of the company was a
plaintiff. During the trial of the case it was the endeavor of the company to place the blame for the wreck on the shoulders of Mr. Kuhn, trying to prove that he had been intoxicated on the day of the wreck and that he had disobeyed orders.
Mr. Kuhn endeavored to show that the wreck was due to the method of running the road then in use by the company, and the verdict would tend to show that he had been successful. The suit was for $25,000, Mr. Kuhn claiming that he had been injured to that extent.
It is not known whether or not the company will abide by the verdict or will appeal to a higher court.
