Claims Damages of $25,000 For Injuries Received In Wreck July 5, 1912
Case Now Before Judge McConnell For Trial
The first case called for trial in February term of civil court before Judge McConnell was that of former Conductor C. H. Kuhn against the Ligonier Valley R. R. Co. The plaintiff claims $25,000 damages for injuries received in the disastrous Wilpen wreck of July 5, 1912, when Kuhn was conductor on the passenger train and the train was backed up the Wilpen branch loaded with passengers and the freight train under Conductor Knox had started to come to Ligonier heavily loaded with coal. The two trains met on the single track at a sharp curve at the Denny race track resulting in a terrible wreck in which 23 people were killed and many others injured. Mr. Kuhn had his arm badly broken and was knocked unconscious. Nearly all the damage cases resulting from the wreck have been settled out of court, the Kuhn case being the last to be disposed of. A large number of witnesses have been subpoenaed from Ligonier who are in attendance at the suit. Monday a jury was secured and C. H. Kuhn, Conductor Knox, of the freight train; E. D. Rathmell and T. E. Peoples, witnesses were heard. The case was on trial yesterday and may be concluded today, perhaps not until tomorrow. Attorneys Gaither & Whitten are in charge of the plaintiff's side of the case and Robbins & Wyant, and Moorhead & Smith represent the Ligonier Valley R. R. Co.
