L.V.R.R. Wreck Cased Brought To Close
Jury Awards Dr. J. B. Johnson For Damages $9,000
Other Cases Settled Out Of Court
In the jury trial of Dr. J. B. Johnson vs. the L.V.R.R. Co., which was given to the jury Tuesday evening of last week and a sealed verdict returned to court same evening, on the opening of the verdict Wednesday morning it was found that Dr. Johnson had been awarded a verdict of $9,000 for injuries received in the wreck on the Wilpen branch of the L.V.R.R. the afternoon of July 5, 1912.
The cases of Mrs. Myrtle Ankney for the death of her husband, John Ankney, and Miss Besse Hoon were settled out of court. Mrs. Ankney receiving $6,500 and Miss Hoon got $2,600 while her father, E. E. Hoon, received $200 for expenses incurred after the wreck in caring for his daughter.
In the case of W. Miles Tosh et al. for the death of his father, John Tosh, the plaintiffs nor their attorneys did not appear and a non-suit was ordered.
In the case of Karl R. Eicher et al. against the railroad company a compulsory non-suit was ordered on the ground that the plaintiff had no right of action.
This settles all of the damage cases for the 23 deaths and more than as many injuries resulting from the disastrous wreck of July 5, 1912, with exception of C. H. Kuhn, the conductor on the passenger train who was severely injured and has entered suit against the railroad company for damages.
It has been the aim of the owners of the railroad to settle all the cases out of court where possible by an amicable adjustment and up to the present time all were settled in this way excepting the above mentioned.
