L..V. R. R. Must At Once Begin The Work On Spring And Weldon Street Crossings

The famous crossing case was ended this morning when Judge Doty handed down his decision, dissolving the injunction which the Ligonier Valley Railroad Company had taken out against the Borough of Latrobe, the object of which was to prevent the borough from compelling the railroad company to erect and maintain grade crossings at Weldon and Spring streets. The hearing on the injunction was heard before Judge Doty last June, at which time John H. Lightcap, the borough solicitor, and C. E. Heller appeared in behalf of the borough and asked that the injunction be dissolved. At the same time the railroad company asked that it be made permanent, arguing that the natural danger of grade crossings and the great inconvenience to which the crossings would put the company should result in a continuance of the injunction. The arguments of the borough prevailed, however, and Judge Doty dissolved the injunction.

The injunction proceedings have been pending before the court for several years., the railroad company having taken out the injunction at the time the borough ordered the crossings put in. The matter was allowed to remain quiescent for a time, the company pleading that it could do nothing until the Pennsylvania railroads improvement work was completed and the grades established. Further delays arose following the completion of the improvement work, and nothing was ever done in the matter until early this summer when the residents and property owners on East Weldon and East Spring streets became active and urged the matter be taken up in the court. The solicitor was appealed to and he at once instituted steps to get a final hearing on the injunction, the result of which was announced this morning.

As matters now stand the railroad company will have to begin the construction of the crossings immediately, or the borough will build them at the expense of the company and if necessary will enter a lien against the companys property for the expense involved.

One crossing will be put in at Weldon street, and one at Spring street. They will undoubtedly be of great convenience to the people living above the L. V. R. R., on these two streets.

There is no hope of ever getting grade crossings at any of the other streets which are at the present time unprovided with crossings, a recent act of the legislature forbidding the construction of grade crossings. The only reason why the two crossings at Weldon and Spring streets are to be put in is because they were ordered by the council, prior to the passage of the act of assembly.

The L. V. R. R. has ten days within which to file exceptions to the decision of the court.
