The following communication from the Superintendent of the Ligonier Valley Railroad was read and on motion filed with thanks.
Ligonier, Pa., June 15, 1886

Burgess of Latrobe,
Dear Sir In reply to your notice to the Ligonier Valley Railroad Company to construct a retaining wall and guard rail, I am instructed on behalf of said company to say. That the company will comply with your request as soon as possible, and to say further that they do so because you believe yourself acting in the line of your duty to require it. And the company wishes to accommodate and oblige the people and officers of Latrobe in every reasonable demand. But at the same time the company does not wish to concede or prejudice any of its legal rights. And it is advised that it is not bound by law to put up the structures in question. There is no condition of the kind in the borough ordinance, and
our company does not as yet occupy the entire three feet and in any event is entitled by law to the regular legal slope outside of the three feet in all cuts, whether along streets or elsewhere, and is not bound to fence off its roadway. The company will cheerfully comply with your request gratuitously however.
